Title III, Part A

Language Instruction for Limited English Proficient and Immigrant Students

The purpose of Title III is to develop educational programs that will help ensure that limited English proficient (LEP formerly called ELL) children, including immigrant children, attain English proficiency, succeed at core academic subjects, and meet the same state academic content and student achievement standards expected of all children. In keeping with the main goals of the No Child Left Behind Act (NCLB), Title III, Part A aims to reform bilingual education by addressing issues of accountability, local control and funding for successful programs.

In Title III legislation, the focus is on LEP children becoming proficient in English without addressing their native language. The legislation shows an obvious preference for programs that quickly move LEP and immigrant students into general classrooms while giving local entities flexibility in the choice of teaching methods.

Title III legislation seeks to streamline program funding by consolidating programs into a formula grant system that, in keeping with the tone of NCLB, is intended to help state educational agencies (LEAs) develop and provide programs, hold them accountable for demonstrated progress, and give them flexibility in choosing and implementing programs.

Funding from the U. S. Department of Education (ED) is available in the form of formula grants to SEAs in each of the 50 states, the District of Columbia and Puerto Rico. The formula is based 80 percent on the number of LEP children in the state and 20 percent on the number of immigrant children and youth in the state. To receive funds, SEAs must apply to ED via a consolidated or individual program application.
